Terms of use
1. Who these terms are between
Bakehouse Collect is published by A Stott, trading as Markland Hill (“we”, “us”).
They apply to you if you install or use the app on a Wix site, and to anyone using this website. If you install the app on behalf of a business, you confirm you are entitled to accept these terms for it.
Your use of Wix itself is governed by Wix's own terms, not by ours. We are an independent publisher and are not affiliated with or endorsed by Wix.com Ltd.
2. What the app is
An app you install on your own Wix site that lets your customers choose a collection date and time at checkout, and gives you production lists, box recipes, a counter till, allergen checks and storefront offers built on top of what your Wix store already holds.
It runs on Wix's infrastructure and stores what it records in your own site's CMS. We operate no server and hold no copy of your data — see the privacy policy.
3. Plans, payment and trials
- The free plan is free, and is not a trial. It does not expire. It includes collection times at checkout within a seven-day booking window; your opening hours and slot length; a cap on how many collections you take in one slot; one notice period and one weekly order deadline for the whole shop; unlimited closed dates and holiday ranges; customers rescheduling themselves; collection reminders; your collections diary; Wix automations; the market stalls widget; and the privacy tools — retention, erasure and export.
- The paid plan adds booking as far ahead as you choose, notice periods and deadlines per category, weekly caps on orders and on bakes, the production lists, box recipes and box stock, the counter till, the product and allergen checks, the storefront offers, and moving your products to another site. The plans page sets out every feature and which plan it sits on.
- It is charged monthly or yearly, at the price the Wix App Market shows when you subscribe. Wix sets the price in pounds from our US dollar price at its own exchange rate, so the prices on this site are a guide to it.
- Where a free trial is offered, Wix will manage the subscription and billing process. Unless cancelled before the trial ends, the subscription will convert to the applicable paid plan in accordance with the Wix billing process shown when you subscribe.
- Payment is taken by Wix, under Wix's billing terms. We do not receive or store your full payment card details. Cancellation, refunds and billing disputes follow Wix's process.
- If a paid subscription ends, the paid features stop and the free plan continues. Nothing you have recorded is deleted by a downgrade.
- We may change prices. An existing subscription keeps its price until the end of its current billing period, and we will give reasonable notice of a change before it applies to you.
4. What you are responsible for
The app is a tool you operate on your own site. You remain responsible for your business, and in particular for:
- The accuracy of what you configure. Opening hours, notice periods, deadlines and capacity caps determine what your customers are offered. If they are wrong, the times offered will be wrong.
- Honouring the collections you accept. A booking made through the app is an arrangement between you and your customer. We are not a party to it.
- Telling customers when something changes. If you move a collection after an order is placed, the app records the change on the booking and on the order's timeline, but it does not notify your customer unless you have connected the collection-changed automation. Telling them is your responsibility.
- Your own legal obligations, including consumer, distance-selling, food safety and food information law.
- Being the data controller for your customers' information, and answering their data requests. See the privacy policy.
5. Allergen and ingredient information
The allergen tools are a checking aid, not a source of truth. They compare the spreadsheet you provide against what your product pages say, and report differences. They do not know what is in your food.
A clean report means the two lists agree — not that either is correct. The check reads what you have written in two places and tells you where they disagree. Where both are wrong in the same way there is nothing to disagree with, and it will report nothing. It cannot see your kitchen, a supplier's specification, or a recipe you changed this morning.
You remain responsible for the food information you provide to your customers and for complying with the food information and allergen requirements that apply to your business. Providing the tools you check that information with does not make it our responsibility.
The allergen export is a record of what you entered, not a certification of it. Nothing the app reports removes the need to check your own records.
6. The counter till
The counter records a sale in your Wix store as an order marked paid offline, and adjusts stock accordingly. It does not process card payments, does not connect to a card terminal and never handles card details. Taking payment, giving change and meeting any till, receipt or tax requirements that apply to you are yours to do.
7. Availability
We aim to keep the app working and to fix faults promptly, but it depends on Wix's platform and APIs, which we do not control. We do not promise uninterrupted or error-free operation, and we may release updates that change how features behave.
Where Wix changes or withdraws something the app relies on, a feature may have to change or stop. If that happens to a paid feature, we will say so, and you may cancel.
8. Uninstalling
Worth knowing before you install. Once the app's plugins have been placed on a site, Wix does not allow the app to be uninstalled, and provides no route for an app to remove its own placements. Your site is unaffected and continues to work normally — the app simply remains installed.
If the app must be removed, Wix Support can do what we cannot.
9. Acceptable use
You agree not to:
- use the app unlawfully, or to handle data you have no right to handle;
- attempt to access parts of it you have not been granted access to, or to interfere with its operation or another site's;
- copy, resell, sublicense or redistribute the app, or reverse engineer it except where the law says you may.
We may suspend access where use is unlawful, or where it threatens the operation of the service for other users. We will tell you why.
10. Intellectual property
The app, this website and their contents remain ours. Your data, your products, your images and your content remain yours. Installing the app grants you a non-exclusive, non-transferable right to use it on the sites you install it on, for as long as these terms are in force.
11. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, and because this is a low-cost business tool:
- We are not liable for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, or for any indirect or consequential loss.
- We are not liable for loss or corruption of data held in your Wix site, or for anything arising from Wix's platform, its APIs or its availability.
- Subject to the exclusions and protections above, our total aggregate liability to you arising out of or in connection with the app or these terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited in any twelve-month period to the greater of: (a) the fees you paid for the app during that period; and (b) £25.
The app is provided on an “as is” basis, and except as stated in these terms all warranties and conditions implied by law are excluded to the fullest extent permitted.
If you are a consumer rather than a business, your statutory rights are unaffected by any of the above.
12. Ending these terms
You may stop using the app at any time, subject to section 8. We may end these terms on reasonable notice, or immediately where you are in serious breach of them. Sections 4, 5, 10, 11 and 14 survive.
13. Changes to these terms
We may update these terms. The date at the top changes when we do, and where a change materially affects you we will give notice through the app or by email before it takes effect. Continuing to use the app after that means you accept the revised terms.
14. Law and jurisdiction
These terms and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that if you are a consumer resident elsewhere in the UK, you may bring proceedings in your own jurisdiction.
